Customers Beware !!!!

Web www.sadashivan.com

The purpose of this site is to make known the bad experiences of the customers with vendors.  This is a curse, which most consumers face, yet getting justice is far far away. In many countries, the justice is injustice especially where the process is difficult and humiliating. Seeking justice is too complicated or late that discourages to get involved in problems or have least information about their rights. In developed countries, still the awareness is effective. However, the customers of developing countries are most unfortunate. In most cases, the vendors refuse to take back the defective products or are overcharged. Government justices laid only in the official documents or papers and the implementation is rare. Government initiatives have failed giving justice to the customers. Thus, the helpless consumers remain helpless despite claims of government’s efforts for justice.

Over 80% percent of the customers do not go through the terms and conditions of the product manufacturers or the vendors while they are into buying process. Most terms and conditions printed in the reverse of invoices are in very small latter and long sentences and handed over to the customer after the purchase is done or payment is made, which generally customers avoid reading. Did we ever realize that this would lead to consequences when we find the product has manufacturing defect. Returning the defective items becomes most difficult finally in most cases the issue leads to bitter arguments and bad customer experiences. Finally, the vendors win by excuses of having intimated in the invoice.

I give an example of a woman, who purchased the gold bangles from a shop of the branded name in gold ornaments in India. The reputations of the vendor prompted her to purchase the bangles from that shop. She chose a design that had joint (CLICK THE LINK) but the sales people convinced her for quality of the item and promised to take guarantee.  Finally, she bought and paid the amount. Sales person packed the printed invoice in envelop and handed over to her. In good faith, she did not open envelop to check the invoice. She did not realize the envelop containing the invoice had red stamped “Exchange within 3 days no refund.” She experienced the same what she observed about the joint, the joint came out when in an occasion she wore; the joint in the bangle could not be set even after the repair so she requested the vendor for exchange. For the exchange she was required the bare to labour cost and difference of current and past price. Is it not shocking and disappointing for a woman who spent her hard-earned money to loose? Do you too wish to loose? If not please look into the terms and conditions of the vendor before you involve into purchasing. This is a must in this world!!!!!!!

Now the issue is that do we really visit the shop to read their terms and condition after the purchase? In our mind are the products for which we enter the shop and not their terms and condition!!! The purpose of a customer is to buy reliable products from a reliable shop to avoid any unwanted consequences. It becomes the responsibility of the vendor and the authorities to facilitate the customers to know the terms and the conditions before the purchase of the items. Therefore, the customer has a choice to accept or reject before involving into purchase.

  • Vendor’s terms and conditions should be at the entrance of the shop or on the Ad banners displayed before the shop.
  • Product terms and conditions should be at the rack where the product is on display.
  • Invoice is an authentication of payment made and received. This instrument should not be used to notifying terms and conditions. As this document is issued, only after the payment made by the customer. Therefore, I feel the validation of terms mentioned in the invoice is not justified.
  • Vendor need to display bold written terms and conditions where the product is on display. In addition, should also have on the tags of its warranty or guarantee in order to facilitate the customer for choice. This gives clear mind to the customer during purchase. Authority’s responsibility is to make this as mandatory system for all, specially branded products.

Consumer guidance society of India: SINCE INDEPENDENCE, India has been striving to develop and strengthen its industrial base. In this pursuit of "self-sufficiency", however, the consumer has been made to endure sub-standard products and services: adulterated foods, short weights and measure, spurious and hazardous drugs, exorbitant prices, endemic shortages leading to black marketing and profiteering, unfulfilled manufacture guarantees, and a host fo other ills. In one infamous case, forty persons were struck with dropsy and glaucoma after consuming groundnut oil adulterated with toxic argimon oil. The culprits were never brought to justice. This outrage energised nine ladies to organize a movement to fight for consumer rights. They formed the Consumer Guidance Society of India (CGSI) to resist consumer exploitation of all forms.
